Jane Kupsch

Jane is a Partner in Piper Alderman’s national dispute resolution team based in Melbourne.

Jane is one of only 65 Victorian lawyers who are accredited by the Law Institute of Victoria as a commercial litigation specialist.

Jane’s experience spans a broad range of litigation and alternative dispute resolution processes in various state and federal courts and tribunals. She has been involved in a number of multi-party, large scale disputes (including class actions) in the superior courts.

Jane has particular expertise acting for company directors and officers in litigation and regulatory investigations arising from the failure of public companies. Jane’s experience means she can provide sound advice to both company officers and insolvency practitioners when a company is in distress or under external administration, and when steps need to be taken to protect or challenge the competing interests of creditors or other stakeholders. She is also able to provide practical advice to companies and their boards regarding issues such as risk management and insurance.

Jane has also acted in insolvent trading and preference claims, disputes between shareholders, contract disputes, matters concerning alleged misleading or deceptive conduct in a commercial setting, disputes involving the protection of intellectual property rights and confidential information, professional negligence claims, franchising disputes, employment matters (in particular, senior executive dismissals), defamation matters and disputes concerning the liability of insurers. Jane has also provided ‘clearance’ advice to the producers of a live national television program.

Jane takes a ‘whole picture’ approach that is focused on achieving early and cost-effective commercial outcomes for her clients. In addition to her technical expertise, if litigation is necessary, Jane’s experience in large-scale litigation means she possesses the project management skills that are essential to the safe and economic carriage of litigation through the competing requirements of the courts’ processes and the strategic and commercial interests of her clients and other stakeholders.
